Williamstown Cemetery Rules & Covenants

In strict subservience, however to the charter of the Williamstown Cemetery, and such laws and by-laws as may be made in accordance therewith.

The covenants, obligations and benefits contained in this Agreement shall run with the land and shall be binding upon and inure to the benefit of the parties hereto, and their respective heirs, successors and assigns.  In the event of a sale or transfer of all or any portion of the property, the purchaser or transferee shall assume all rights and obligations hereunder, and such assumption may be evidenced in the deed or other transfer document, or may be made in a separate instrument, but, regardless of the form of document or instrument or lack thereof, shall automatically take place upon the receipt of the deed or other transfer document by the purchaser or other transferee, including as follows:

  1. No person shall erect or place on or in any part of the lands within Section "K & L" of the Williamstown Cemetery, any monument, stone, marker or other device which extends more than one (1) inch above the surrounding land surface around such monument, stone, marker or device be lowered than one and one-half (1-1/2) inches below the surface of the adjoining land.

  2. No person shall drive on or over any roadways within the Williamstown Cemetery except for the purpose of visiting the grave of a particular, identifiable deceased person or persons or for the purpose of paying respect to identifiable deceased person or for participating in the internment of a relative or friend or for the purpose of conducting business within the Williamstown Cemetery.  However, that equipment used by the personnel of the Williamstown Cemetery shall be exempt from this provision while engaged in caring and maintaining the Williamstown Cemetery.

  3. No person shall permit any animal or domesticated fowl to run at large in the Williamstown Cemetery.

  4. No person shall drive any motor vehicle, animal or animal drawn vehicle over any part of parts of the Williamstown Cemetery other than designated roadways therein, provided, however, that equipment used by personnel of the Williamstown Cemetery shall be exempt from this provision while engaged in caring for the Williamstown Cemetery.

  5. Pedestrian visitation and/or walkers use of the Williamstown Cemetery shall be permitted during the hours of sunrise to sunset prevailing time.

  6. Planting(s), annual(s), perennial(s), shrub(s) and/or trees shall not be sown or transplanted within the Williamstown Cemetery, except under the following conditions:

    1. Planting(s), annual(s), perennial(s), shrub(s) shall be permitted to be sown or transplanted within the Williamstown Cemetery at the front or head of the grave monument(s) and/or grave marker(s) in a plant bed area not to exceed twelve (12) inches in width from the front or head of grave monument(s) and/or grave marker(s); and

      Planting(s), annual(s), perennial(s), shrub(s) shall be permitted to be sown or transplanted within the Williamstown Cemetery at the end(s) of grave monument(s) and/or grave marker(s) in a plant bed area not to exceed eighteen (18) inches in width from the end(s) of grave monuments or grave markers.

    2. Planting(s), annual(s), perennial(s), and/or shrub(s) shall not exceed thirty-six (36) inches in height at any time.

    3. No tree(s) shall be planted in the Williamstown Cemetery except as designated and approved as to location, size and variety by the Mayor of the City of Williamstown, Kentucky and the Sexton(s) of the Williamstown Cemetery.

    4. All planting(s) and plant beds shall be mulched, grass trimmed, weeded, pruned and maintained by the person(s) so placing such planting(s) and creating said plant beds.

    5. No planting(s) as heretofore described and planted in the Williamstown shall encroach on the other grave(s) or lot(s) within the Williamstown Cemetery.

    6. Any planting(s) or bed(s) as heretofore described and planted or failed to be maintained or encroaching on grave(s) or lot(s) in violation hereof shall be removed by the City of Williamstown to maintain, preserve the general appearance or to prevent safety risks in or about the Williamstown Cemetery.

  7. No flower containers made of sheet metal, glass, pottery or plastics shall be placed within the Williamstown Cemetery; invertible vases of durable materials and vases designed for and secured to a headstone may be used if constructed of durable materials.

  8. No artificial flowers, wreaths or floral pieces shall be placed or left on any grave for any period of time during the period from April 1st through September 30th, except:

    1. Such items may be placed on graved during the period beginning seven (7) days before and ending seven (7) days after Memorial Day.  All such items shall be removed by the person so placing them, on or before the end of such period.

    2. At and immediately following the internment of a deceased person cut flowers, artificial flowers, and other memorial wreaths and floral pieces may be placed on such grave, provided, however that such items shall be removed within five (5) days following such internment.


      All such flowers , real or artificial, wreathes or memorial flowers and the containers in which they are contained may be removed in a lesser period of time when necessary to maintain or preserve the general appearance of the Williamstown Cemetery or to prevent safety risks.

  9. No fence, railing or curb shall hereafter be erected on or placed around any grave or group of graves within the Williamstown Cemetery.

  10. The Williamstown Cemetery grounds shall not be used as a playground or picnic ground.

  11. No student and/or driver training is to be conducted within the Williamstown Cemetery.

  12. No person(s) and/or vehicles shall be in the Williamstown Cemetery prior to one-half (1/2) hour before sunrise or one-half (1/2) hour after sunset prevailing time.
